This licence refers to software and documentation (the "Material") originated by and supplied by Aculab, via the ApplianX website, or by any other means. The use of any third party software shall be subject to the terms of the licence issued by the licensor of the relevant third party software.
All copyright and intellectual property right in any such Material in any form whether printed or stored electronically shall remain with Aculab, and in no circumstances shall any title or copyright in any such Material be conferred.
All such Material is provided solely for use in conjunction with ApplianX products.
Except as provided herein, no such Material or any part of such Material shall be copied, reproduced or utilised in any form or by any means whatsoever without the written approval of Aculab.
Aculab hereby grants a non-exclusive licence to use the Material in the form provided.
The standard warranty of 2 year applies to all ApplianX components. All cover is return to supplier.
Aculab warrants that at the time of delivery the ApplianX product supplied hereunder will be free from defects in material and workmanship. The standard warranty does not cover damage, deterioration or malfunction resulting from; Accident, misuse, neglect, fire, water, lightening, or other acts of nature; unauthorized product modification, or failure to follow instructions supplied with the product; repair or attempted repair by anyone not authorized by your supplier; causes external to the product such as electric power fluctuations or failure; normal wear and tear; any other causes which do not relate to a product defect.
Under no circumstances including but not limited to negligence shall Aculab be liable for any direct, indirect, special, incidental or consequential damages including but not limited to loss of data or profit arising out of or in connection with the use or the inability to use or performance of the Materials in this site, even if Aculab or an authorised representative of Aculab has been advised of the possibility of such and whether based in an action in contract tort or any other theory of liability.
Two pieces of legislation came into force during 2005 and 2006. These were:
1. The EC Directive 2002/96/EC on Waste Electrical and Electronic Equipment (WEEE). The WEEE Directive aims to increase the proportion of Electrical and Electronic Equipment (EEE) recycled, with the objective of reducing the level of waste materials, including potentially hazardous materials, entering the environment.
2. The EC Directive 2002/95/EC on the Restriction of the Use of Certain Hazardous Substances in Electrical and Electronic Equipment (ROHS)
Aculab has met its obligations under the WEEE Directive for collection, marking of products and take back of EEE, which came into effect from January 2006.
Aculab commenced a RoHS project in 2003 to determine the impact of this legislation across its business and that of Aculab's customers and suppliers. Following extensive dialogue with suppliers and assemblers, Aculab has met the requirements of the RoHS Directive, by the due date.
All ApplianX products currently shipping are fully RoHS compliant, presently expressed as '6 of 6'.
Statutory Instrument (SI) 2005 No. 2748, dated 25th September 2005, confirms and clarifies the exemption of lead used in solders, when used in servers, storage and storage array systems, network infrastructure equipment for switching and signalling transmission, as well as network management for telecommunication.
